Terms of Service
Effective June 4, 2026
These terms govern your use of WhaleSay, a whimsical “human to whale” translator operated from Ontario, Canada. By using WhaleSay — the app or this website, including viewing a shared link — you agree to them. If you do not agree, please do not use WhaleSay.

- Premium whales cost money subscriptions renew until you cancel them in your app store.
- Shared links are public anyone who has the link can view it, and it expires in about a month.
WhaleSay is whimsical entertainment, not accurate cetacean communication.
1. The service
WhaleSay turns text or speech into a playful, dialect-aware sequence of whale “tokens” and generated whale audio. It is provided for entertainment. This website also hosts public links to shared translations, which anyone holding the link can view.
2. Eligibility
You must be at least 13 years old to use WhaleSay. By using the app you confirm that you meet this requirement.
3. Acceptable use
You agree not to:
- Submit unlawful, infringing, abusive, or otherwise harmful content.
- Scrape, reverse engineer, or attempt to extract the source of the service.
- Interfere with, overload, or disrupt the service or its infrastructure.
- Use automated means to send high volumes of requests outside normal app use.
4. Purchases and subscriptions
Two whales are free (Humpback and Blue). The premium whales (Orca, Beluga, Sperm, and Narwhal) unlock either through a one-time in-app purchase or an active subscription. A subscription unlocks all whales plus the higher-fidelity audio engine.
Purchases and subscriptions are processed by the Apple App Store or Google Play and managed through our provider RevenueCat. Subscriptions renew automatically until you cancel them in your store account. Refunds are handled by the app store under its own policies, not by us directly.
5. Intellectual property
WhaleSay — the app, its branding, the translation engine, the whale dialects, and the whale audio it generates — belongs to us. You keep ownership of the words and voice input you submit; you grant us a limited licence to process that input to provide the translation service. When you share a translation, you make that generated audio viewable through a public link; you remain responsible for the input you chose to translate.
6. Sharing
When you share a translation, WhaleSay creates a public link to that whale audio. Anyone who has the link can view and play it — treat a shared link as public, not private. Shared links are not encrypted. A link stays live until about 30 days after the translation was first created, then stops working. We may remove shared content that breaks these terms.
7. Disclaimer
WhaleSay is whimsical entertainment. It does not produce accurate cetacean communication and should not be relied on as such. The service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
8. Limitation of liability
To the fullest extent permitted by law, WhaleSay and its operators will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service.
9. Availability and changes to the service
We may add, change, or remove features, and we may suspend or discontinue the service, at any time without notice.
10. Termination
We may suspend or end your access to WhaleSay if you breach these terms or use the service in a way that could harm us, other users, or third parties.
11. Changes to these terms
We may update these terms as the app evolves. When we do, we will revise the effective date above and, for material changes, provide a more prominent notice. Continued use after changes means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute.
